Terms and Conditions - Ania Liesting Portraits

1. General
1.1 These terms and conditions apply to all agreements and services provided by Ania Liesting Portraits (hereinafter referred to as "the Photographer").
1.2 By booking a photoshoot or entering into any other agreement with the Photographer, the client accepts these terms and conditions.

2. Services and Prices
2.1 The Photographer offers photography services, including portrait photography, business portraits, sensual photoshoots, and other custom photography services.
2.2 The prices for these services can be requested from the Photographer and may be adjusted based on specific client needs.
2.3 The Photographer reserves the right to change prices, but the prices applicable at the time of booking will remain valid for that specific agreement.

3. Payment
3.1 Payment for the photoshoot and any additional services must be made in advance, unless otherwise agreed.
3.2 Payment can be made via payment request, website, invoice, or any other agreed-upon method.
3.3 All payments must be made within the agreed period. If the payment deadline is exceeded, the Photographer reserves the right to suspend the service.

4. Cancellation and Changes to the Booking
4.1 Cancellations are not possible. Photoshoots can be rescheduled free of charge up to 5 days before the scheduled shoot.
4.2 If the client does not show up on the agreed date, the full amount will be charged.

5. Force Majeure
5.1 In the event of force majeure, such as extreme weather conditions, illness, or other unforeseen circumstances, the Photographer reserves the right to postpone or cancel the photoshoot. In such cases, a new appointment will be made or the amount will be fully refunded.

6. Copyright and Use of Images
6.1 All rights to the images remain the property of the Photographer, unless otherwise agreed in writing.
6.2 The client has the right to use the images for private and commercial purposes.
6.3 It is not allowed to alter the delivered images by applying filters, adjusting colors or contrast, or manipulating the images in any other way.

7. Delivery of Photos
7.1 The Photographer will deliver the images within the agreed period after the photoshoot and in the agreed-upon manner.

8. Privacy and Data
8.1 The Photographer processes personal data of the client solely for the purpose of the photoshoot, the subsequent delivery of the images, and for legal obligations to retain data for tax purposes.
8.2 The Photographer will not share personal data with third parties unless it is necessary for the execution of the agreement.

9. Liability
9.1 The Photographer is not liable for damage to the client or third parties, except in cases of intent or gross negligence.
9.2 The client is responsible for providing a suitable location for the photoshoot if it takes place outside the studio and for supplying all necessary materials and information for the session.

10. Applicable Law
10.1 These terms and conditions are governed by Dutch law.
10.2 In case of disputes, unless otherwise agreed, the competent court in the district where the Photographer is located will have jurisdiction.

11. Consent for Photos
11.1 By booking a photoshoot, the client explicitly gives permission to the Photographer to take, edit, and store photos of them for both private and commercial purposes, unless otherwise agreed in writing.
